How can I help my loved one who can no longer make personal and financial decisions due to incapacity?

Are you concerned your loved one can no longer made personal or financial decisions for themselves due to incapacity? Does your loved one suffer from dementia or Alzheimer’s? 

• The first step in a guardianship case is for the court to decide whether a person is incapacitated. 
• The Florida statutes define an incapacitated person as, “a person who has been judicially determined to lack the capacity to manage at least some of the property or to meet at least some of the essential health and safety requirements of the person.” 
• If an incapacity determination is made, the court will then consider appointment of a guardian to make personal and financial decisions on that person’s behalf. 
• A guardian is required to report to the court regularly. It is an ongoing obligation through which an attorney can guide you.
