Abused Spouse/Child Petition – Who qualifies to submit an abused spouse or abused child petition?

  • Immigrants who have become victims of domestic violence in the form of mental or physical abuse by a U.S. citizen or Lawful Permanent Resident may be eligible to apply for classification as an abused spouse or child. Immigrants who are classified as abused spouses or children are then able to apply for Lawful Permanent Residence as a result.
     
  • Abuse for the purpose of an abused spouse petition can be mental or physical. Victims generally underestimate the amount of abuse they have suffered.  As such, Elizabeth Cuenca, P.A. recommends a consultation to determine eligibility. Asylum What is Asylum and am I eligible for it?

  • Immigrants may apply for asylum in the United States if they have been persecuted in the past or there is a high likelihood that they will be persecuted in the future if they return to their country of origin.

  • Persecution for purposes of asylum must be based on race, religion, nationality, membership in a particular social group, or political opinion.

  • While applicants for asylum are pending an application, they are eligible for work authorization in the United States. If work authorization is granted, an immigrant may obtain a Social Security number and a driver’s license.

U-Visa- Who can apply for a U-Visa?

  • Victims of certain crimes in the United States may be eligible for classification as a U Nonimmigrant if they suffered substantial mental or physical abuse as a result of the crime, have information about the crime, and have been helpful to government officials in the investigation or prosecution of the crime.

  • Immigrants who entered the United States illegally may still be eligible for the U-Visa if they can obtain a waiver.

  • Classification as a U Nonimmigrant can lead to work authorization in the United States and eventual Lawful Permanent Residence.

T-Visa- Who can apply for a T-Visa?

  • Victims of human trafficking in the United States may be eligible for classification as a T Nonimmigrant if they have been helpful to law enforcement officials in the investigation or prosecution of their trafficker.

  • Classification as a T Nonimmigrant can lead to work authorization in the United States and eventual Lawful Permanent Residence.
